About This Item
Washington DC: Gales and Seaton, 1832. Pamphlet. 39p. pamphlet, disbound, paper toned and foxed, otherwise very good. Worcester, a missionary, was accused of "residing within the limits of the Cherokee nation without a license" and "without having taken the oath to support and defend the constitution and laws of the state of Georgia." He was sentenced to four years' hard labor. Worcester appealed the decision, arguing that Georgia had no authority to pass laws governing Cherokee territory, and the Supreme Court overturned his verdict. Although in this case the court had upheld the right of tribal territories to self-government, president Jackson ignored the precedent as he continued to undermine the treaties that had been signed with indigenous political entities.
